3. Account Registration

To access certain features of our Services, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept responsibility for all activities under your account
• Immediately notify us of any unauthorized use of your account

You must be at least 18 years old to create an account. By creating an account, you represent that you are at least 18 years of age.

4. Acceptable Use Policy

5. Services Description

Our email validation service checks email addresses for deliverability, syntax validity, and other factors. While we strive for accuracy, we cannot guarantee 100% accuracy in all cases, as email server configurations can change.

5.2 Blacklist Monitoring

Our blacklist monitoring service checks your domains and IP addresses against known email blacklists. We provide alerts when listings are detected but cannot guarantee removal from third-party blacklists.

5.3 Email Warmup

Our email warmup service helps establish sender reputation for new email accounts. Results may vary based on factors outside our control, including email content and recipient engagement.

6. Payment Terms

Certain features of our Services require payment. By subscribing to paid features, you agree to:

• Pay all fees associated with your selected plan
• Provide accurate billing information
• Authorize us to charge your payment method for recurring subscriptions

All fees are non-refundable unless otherwise specified. We reserve the right to change our pricing with 30 days' notice. Continued use of the Services after a price change constitutes acceptance of the new pricing.

7. Intellectual Property

The Services, including all content, features, and functionality, are owned by Blacklist Guard and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any data you submit to the Services. By using our Services, you grant us a limited license to process your data solely for the purpose of providing the Services.

8. Disclaimer of Warranties

We do not warrant that the Services will be uninterrupted, error-free, or completely secure. Your use of the Services is at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLACKLIST GUARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Business interruption
• Damage to sender reputation
• Email deliverability issues

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Blacklist Guard and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of a third party
• Your email sending practices

11. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination, your right to use the Services will immediately cease.

Sections that by their nature should survive termination will survive, including intellectual property provisions, warranty disclaimers, and limitations of liability.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting a notice on our website or sending an email. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
